FAQs - Chillhop Sample Pack Sounds

Unless otherwise stated here, any terms used below are based on the definitions provided in the Chillhop Sample Pack Sounds License Agreement and webshop Terms of Service (together, the “Agreement”).

Q: What is a Chillhop Sample Pack?

A: A Chillhop Sample Pack is a curated selection of downloadable sounds and sound production materials, which we collectively refer to as the “Sounds” in the license (and in this FAQ). In certain packs, the Sounds may include things other than audio files - such as plugins, presets, MIDI patterns, etc.

Q: Are all Sounds in the Chillhop Sample Packs royalty-free?

A: Yes. In conjunction with your purchase of the product, you are granted a royalty-free license for every Sound in the purchased Chillhop Sample Pack, available for download via the shop.chillhop.com webstore.

Q: Are all Sounds in the Chillhop Sample Packs non-exclusive?

A: Correct. Within a the license you are granted non-exclusive usage rights to each Sound that you download from the Chillhop Sample Pack - meaning other individuals can also license, download and use the same sounds in the Chillhop Sample Pack without infringing on any New Recording or audio-visual Creative Works you create using that sound and vice versa.

Q: Can I use sounds from Chillhop Sample Packs for commercial use?

A: Yes. The license for sounds you download from a Chillhop Sample Pack permits use for commercial and non-commercial purposes, so long as you remain in compliance with your Chillhop Sample Pack license terms.

Q: Can I use sounds from the Chillhop Sample Pack in more than just music (like videos, films, or games)?

A: Yes. You can use sounds you licensed and downloaded from a Chillhop Music website/store, or authorized retailer, both commercially and non-commercially in each of the following ways:* 1. New Recordings: combined with other sounds in new music productions 2. Audio-visual Creative Works: In various other projects including video games, film, television, online applications, etc. 3. Live performances and audio broadcasts, such as radio.

Q. Can I sell a beat or instrumental I made using sounds from the Chillhop Sample Pack as royalty-free music?

A: Chillhop does not prevent users from distributing New Recordings, as defined in the License Agreement, on other platforms as non-exclusive, royalty-free music but it is ultimately up to that platform. Libraries may have specific rules and restrictions so you should confirm with those platforms. However, you may not distribute any use or distribute and Sounds from the Chillhop Sample Pack as (or as part of) samples or loops (more on that below).

Q: What are the limitations of my license to use sounds from Chillhop Sample Packs?

A: Here are a few things you can’t do with sounds you licensed and downloaded from Chillhop Sample Packs: Sublicense Sounds in isolation as samples, sound effects, loops, or as source material for any other sample (even if you modify the original sample); 2. Use sounds in a way that’s competitive to Chillhop Music or its licensors, like redistributing them in new Chillhop Sample Packs; 3. Outside of including the Chillhop Sample Pack in the production credits of a New Recording, Creative Work or Live Performance, you cannot use the name, image, likeness, trademarks, copyrights of Chillhop Music, the artist or any creator associated with a Sound in any way without express written permission of Chillhop Music (which you are solely responsible for obtaining). This includes prohibiting the mention of the above parties as a collaborator, co-creator, featured artist, or releasing artist on any media production containing the Sounds.

Q: Does music I made using Sounds from a Chillhop Sample Pack fall within the public domain, under something like Creative Commons / CC0?

A: A public-domain license such as CC0 is not appropriate if you used non-exclusive, royalty-free sounds such as audio samples or any other materials (i.e. the Sounds) from Chillhop Sample Packs. While you have full ownership of your New Recording or audio-visual Creative Work made with the Sounds from a Chillhop Sample Pack, you do not own exclusive rights to the actual Sounds themselves.

Q: What do you mean by not being able to use the “likeness” of an artist in my work?

A: Based on the License Agreement, webshop Terms of Service, and further defined in the EU’s Convention of Human Rights (ECHR), a “likeness” can include any visual or audible (voice) representation of a person or persona or any other identifiable characteristics of such person(s). Therefore, you may not use the name, image, likeness, trademarks or property of Chillhop Music or any creators whose sounds are promoted, featured or distributed by Chillhop Music without Chillhop Music’s express permission. Some examples of using the name of likeness of a creator would be to include a photo of them when promoting your track, crediting them as a feature on your track, and/or including them as a contributor to the track for splitting royalties or otherwise.

Q: Do I lose this license if I lose my receipt/proof of purchase?
A: The license for any Sounds downloaded from a Chillhop Sample Pack is only valid in conjunction with a verifiable proof of purchase. Feel free to contact us if you would like to confirm/re-obtain a proof of purchase.

Q: Do I have 100% ownership of my composition if I use sounds from Chillhop Sample Packs?

A: You have ownership of your New Recording or audio-visual Creative Work made with sounds from Chillhop Sample Packs, but you don’t own the exclusive rights to those samples or the underlying musical compositions within those samples. Other licensees can use the same Sounds without infringing on your track and vice versa.

Q: Can I register my creative work for a copyright?

A: We don’t restrict copyright registration for New Recordings or audio-visual Creative Works you make using sounds from Chillhop Sample Packs, but recommend consulting your own legal counsel for further information on matters concerning copyright registration.

Q: Do I need to give Chillhop or the sample creator credit when registering with a PRO (publishing rights organization) like ASCAP or BMI? What/who do I put under “vocalist” or for the lyrics when registering a song containing a Chillhop vocal sample with a PRO?

A: You are the owner of any New Recordings you've made using sounds from Chillhop Sample Packs, however, you have a license to, not ownership of, those sounds (meaning other users can also use those sounds in their own New Recordings). While you are required to disclose that you are using audio samples in your New Recording, you do not need to credit Chillhop or the sample creator as they are not a co-owner of your track.

Q: Are individual loops or one shot samples purchased from Chillhop ineligible for monetization on other content platforms?

A: Samples licensed and downloaded from Chillhop Music Chillhop Sample Packs are yours to use in combination with other sounds in commercial or non-commercial works without the need to pay royalties or include any sort of attribution to Chillhop or the sample creator. This commercial use applies to uploading your new content on platforms or services outside of Chillhop. However, distributors or individual stores/platforms may have specific rules or restrictions for what material is eligible for monetization. For example, services may require exclusive rights to all source content (such as individual samples), which is not possible with non-exclusively licensed samples (including any samples downloaded from the Chillhop Sample Packs). We recommend you consult with the third-party platform you are seeking to work with for more detailed information on the specific monetization requirements of that platform.

Q: If I use an unedited, isolated audio loop as the beginning of my composition, is that covered by the royalty-free license?

A: Because the audio sample is included in a New Recording (i.e. in combination with other recorded sounds), the sample is covered by the royalty-free license even if the sample is soloed at some point in the track. (*) Please refer to the License Agreement and webshop Terms of Service for more information about limitations or prohibited uses.
